Her dad, Jerry(L), a Louisville attorney, had a general practice including family law, and lives across the street from me. Her mom, Freeda Clark, is also a lawyer. The night before I had attended Meghan&#8217;s first fundraising event. Just seven months post stem cell transplant, this young woman was trying to raise money for the Leukemia and Lymphoma society. She could appear only briefly because of the risk of infection. Jerry led the ceremonies. It was a big success. </p>
<p>When any of us takes stock of a year of accomplishments, it is instructive to look at Meghan&#8217;s efforts. That first event was just the tip of an iceberg. <p> Meghan’s Mountain is the story of Sarah “Meghan” Steinberg’s climb to life, and her efforts to make the world aware of the devastating effects of cancer and the need for all of us to work together to raise awareness and funds to find a cure for cancer. Meghan’s Mountain, in addition to raising funds for research, reaches out to those afflicted with cancer so that they know they are not alone in their climb to life.<br />
On January 29, 2005, Meghan, at the age of twenty-two and a student at the University of Louisville school of Justice Administration, was diagnosed with leukemia (AML). Because of her illness, Meghan had to withdraw from college, give up her part time job and begin the fight of her life-the fight to live.<br />
After spending almost four months in and out of hospitals in Louisville to put her cancer in remission, Meghan, in June of 2005, went to the Fred Hutchinson Cancer Research Center in Seattle, </p>

<p>Washington for a needed stem cell transplant (sometimes called a bone marrow transplant). Without this additional procedure, Meghan would not have had a chance at life.  Meghan underwent four months of treatment in Seattle before returning home in October of 2005.<br />
When Meghan learned she had cancer, she realized that neither she nor her family truly understood what a cancer victim faced in order to live. If they did not understand, then others did not understand as well.  Despite her own battle, Meghan opened up her world on the internet so that others would be able to travel her road with her. Meghan called her journey Meghan’s Mountain, her climb to life. Almost daily an email and/or pictures went out to tell the world what Meghan and her family had to endure on a daily basis in Meghan’s fight for life. Today those emails go to over twenty-five states, forty-three cities, and as far as Africa, India, Mexico and France.<br />
It was not long before Meghan realized the impact of her journey on others. While in Seattle, Meghan received over 400 cards from people who were praying for her, including autographed pictures and best wishes from Kentucky Governor Ernie Fletcher, Lt. Governor Steve Pence, and University of Louisville basketball coach Rick Pitino, as well as the entire U of L basketball team. Meghan received many phone calls, including one from Wes Unseld, general manager of the Washington Wizards wishing Meghan well. <br />
One of the people who touched Meghan and gave her strength in her climb for life was former University of Louisville basketball coach and Naismith Hall of Fame Coach Denny Crum. Coach Crum visited Meghan in the hospital in Louisville, called her on the phone before she left for Seattle and before she returned home, and sent her cards and letters. Coach Crum has helped Meghan with each of her fundraising events. In her honor, Coach Crum agreed to be the 2006 Honorary Chairman of the 2006 Kentucky &#038; Southern Indiana Leukemia &#038; Lymphoma’s Light the Night Walk held in Louisville in October. Meghan and Coach Crum still stay in contact with each other and share their individual desires to help others by donating their time and efforts to those that need us the most.<br />
Meghan observed the pain and sorrow of so many who traveled a mountain like hers and, during her flight back home, decided that she was going to make a difference for all cancer patients. Meghan realized the importance of having love and prayers while climbing a mountain to beat cancer, and wanted to return that love to others.<br />
Since Meghan returned home to Louisville, Kentucky in October of 2005, with the help of hundreds reaching out with her, she has accomplished the following:<br />
1.	Meghan, working with the National Marrow Donor Program in Minneapolis, had her picture of when she received her stem cell transplant on mini-billboards and bus stop shelter signs promoting the need for donors in transplants when a sibling was not a match. She continues to work with the local Marrow Program to inform and get people to volunteer to be donors to help save lives.<br />
2.	Meghan is working with the local Leukemia &#038; Lymphoma Society to prepare baskets of love and information for newly diagnosed patients in local hospitals.<br />
3.	Meghan visits newly diagnosed cancer patients in hospitals to counsel them and let them know that they will not be alone in their climb up their mountain. Meghan, with their permission, tells those that receive her emails about these patients, and asks that emails, cards, gifts and prayers be sent there way. Meghan also “adopts” children in Seattle and Louisville who are going through cancer treatment and talks with them on a regular basis, giving them hope and belief that all things are possible.<br />
4.	Meghan raises funds to buy toys for the children who are fighting cancer in the Children’s Hospital and Regional Medical Center in Seattle, Washington.<br />
5.	Meghan is a volunteer at Kosair Children’s Hospital in Louisville, Kentucky to help those who are fighting cancer and to bring promises of a better and brighter tomorrow to the children who are seeking life.<br />
6.	Meghan has been the keynote speaker at events for the Leukemia &#038; Lymphoma Society, and gives talks to others about the need to raise awareness and funds in the fight against cancer.<br />
7.	Surrounded by Team in Training Members of the Society, Meghan, in April of this year, crossed the finish line of the Kentucky Derby Mini-Marathon on behalf of cancer victims everywhere to let them know that all things are possible if you believe.<br />
8.	Meghan was responsible for having the first Leukemia &#038; Lymphoma Night at the Louisville Bats at Slugger Field. The Louisville Bats are the minor league team of the Cincinnati Reds.<br />
9.	Meghan held events during 2006 to raise money for the Leukemia &#038; Lymphoma Society’s Light the Night in October. Meghan not only raised more money than any other person or corporation for 2006, but also set a new all time Light the Night record for Kentucky and Southern Indiana ($32,000.00 plus).<br />
Meghan was cancer free at one year upon her return to the Fred Hutchinson Cancer Research Center in Seattle in July of 2006. She has returned to college, but has changed her major so that she can be a child life specialist helping children with cancer in hospitals like Kosair Children’s or institutions like the Fred Hutchinson Cancer Research Center in Seattle.<br />
Meghan’s dream is to find a cure for cancer, and until then, to reach out to those who are climbing mountains so that their dreams of life can come true. <br />
Meghan’s story has appeared in the Courier-Journal, the Community Paper, and she has appeared on WLKY-TV. Metro Council, the governing body of Louisville, Kentucky, presented Meghan with an award for her efforts in awareness and raising funds to fight cancer. Kentucky Lt. Governor Steve Pence honored Meghan by having her become a member of the Order of Kentucky Colonels.<br />
Through her charitable foundation, Meghan hopes to initiate new programs that will reach cancer victims and their families throughout this country and to raise funds for various organizations and hospitals in the fight to find a cure for cancer. Meghan’s dream is to find a better and brighter tomorrow for all of us.  <br />
Meghan is the 2006 Honoree of the Leukemia &#038; Lymphoma Society’s Journey of Hope Award and the founder of Meghan’s Mountain Charitable Foundation, Inc.</i></p>

<p>Jerry Steinberg, the dad of Meghan Steinberg about whom we are also posting today, was a Big Brother. I will remember the rest of my life going to the 1996 Olympics in Atlanta with one of my best friends, who was a Big Sister along with her Little Sister. With no tickets and no hotel arranged, we loaded them, my niece who was the same age 13, and my daughter, age 6 at the time in the my jeep and headed to Atlanta. We found a new Hampton Inn in Conyers, Ga near the equestrian venue (remember we are from horse country here in Kentucky) and so this dear Little Sister spent her first night ever in a hotel and swam in a swimming pool for the first time. As we were leaving for the stadium jumping event the next day, she was making her bed. The expression on her face when told that a housekeeper would take care of that after we departed was priceless! We take so much for granted. </p>
<p>P.S. We also got to see N. Korea v. Pakistan in the men&#8217;s field hockey event. The multi-national crowd singing and dancing together to &#8220;Y.M.C.A.&#8221;  also remains a treasured memory. </p>

<p><i>In this frigid weather, the Jefferson Family Courts have women coming to the courthouse for domestic violence protective orders and bringing children who are not dressed for the cold. Little kids are coming in without appropriate shoes, coats, hats or gloves. Often the victims have to leave their homes quickly, with no time to collect any clothing or other necessities. </p>
<p>The court staff try to keep a supply of coats there so that they don&#8217;t have to send the kids back out the way they came in, but our supplies are depleted. If you live in the Louisville area and have any extras, or know of folks who might, please consider donating your discarded children&#8217;s winter outer garments.</p>
<p></i>In response to an email asking where to deliver donations, Judge FitzGerald wrote &#8220;Clothing can be taken to the family court clerks&#8217; office. Would you add baby blankets to your list? I left them off and we need them desperately.&#8221;</p>

<blockquote><p>At a time of growing caseloads and increasingly complex situations of abuse and neglect &#8212; often fueled by drugs and alcohol &#8212; judges say the CASA volunteers are becoming increasingly important. </p>
<p>The advocates generally handle one case at a time, while busy social workers may have 15 to 20 or more. </p>
<p>&#8220;CASA makes a tremendous difference,&#8221; said Jefferson Family Court Judge Patricia Walker FitzGerald. &#8220;I wish we could have a CASA volunteer for every child in the system.&#8221; </p>
<p>Jefferson County&#8217;s CASA has about 170 volunteers, while Family Court judges last year handled 3,500 cases of abuse or neglect. </p>
<p>Though judges acknowledge they probably will never have enough volunteers to appoint a CASA worker for every case in family court, they wish there were many more. </p>
<p>&#8220;A lot of times, CASA is the only primary, consistent person in the child&#8217;s life,&#8221; said Stephen M. George, chief judge of Jefferson Family Court. </p></blockquote>

<p><em>A Labor of Love</em> sounds a little corny, but those who have been in law for a long time know what it means and it guides much of what we do in the profession of law.<br />
<em>Bar Briefs</em>, a monthly publication of the Louisville bar Association and not available online (yet?) has this as its title for the front page interview with our new president, Tom Williams. The Kentucky Bar Association is the only required membership of Kentucky attorneys, yet the LBA claims an 80% voluntary participation rate, much higher than the 50% norm of voluntary bar associations across the country. Its leadership has made all the difference, and all for a labor of love.<br />
The words rang particularly true to me, as I recently received a beautiful handwritten letter from retired Judge Richard A. Revell, former Chief Judge of the Jefferson Circuit Family Court. We are working on the annual domestic relations update seminar as well as the 2007 update to <em><em>Kentucky Divorce</em></em>, a West-Thomson treatise. He said that Alan T. Slyn (the original co-author whose updates I am assuming) always said that updating the book was &#8220;a labor of love, for the profession.&#8221; It went straight to my heart; I know exactly what he meant. It is why we have quality legal weblogs, isn&#8217;t it? Blogs are just  a high tech medium of what fine lawyers have been doing for centuries, as a labor of love.<br />
Good luck and best wishes to Tom Williams; your heart is in the right place and you will leave a good legacy, I am sure. </p>

The better assistance the clerks can be to those who cannot afford counsel, the less onerous our judge&#8217;s jobs will be.<br />
Here&#8217;s the email call to action:<br />
&#8220;The Pro Bono Consortium, in coordination with Family Court and the Louis D. Brandeis School of Law, has developed pro se divorce forms that are in their final stages of editing. The pro se packet (over 100 pages) is now available for review at the LBA office and we encourage your participation.<br />
These forms were developed to help meet the needs of those who cannot afford an attorney and appear in Family Court each week unprepared to navigate the legal system. In Jefferson County, at least one-half of the cases heard during motion hour are pro se on one or both sides. Pro se cases create a backlog as most litigants appear before the judges without proper documentation and have to return multiple times to resolve their issues. More importantly, it may limit access to court services for the most needy in our community.<br />
As a reminder, a pro se post-decree packet was created in 2005 through a pilot project between the Consortium and Family Court. Over 100 packets are distributed weekly and the Family Court judges have seen the positive impact of providing accurate forms to these litigants.<br />
If you are interested in reviewing these documents, they will be available at the LBA office from Monday, September 25th until Monday, October 9th. They will not be available on-line until they are ready for distribution. Notification of their completion will be sent to all LBA members via email and through Bar Briefs.<br />
The LBA’s Board of Directors will review comments from its members as they consider endorsement of the pro se divorce program.<br />

I am known to bristle at the suggestion that the practice of divorce law is filling out forms, and I have eschewed forms for twenty-five years. Yet, the volume of cases inundating our courts, and the very limited time our judges have to consider the most complex financial and psychological issues, requires that we who value our system of jurisprudence somehow deal with the massive inundation of cases clogging our dockets. For people who want or must help themselves, making the task easier for them makes the task of the judges many more times less difficult. Each week they come back on the same motion because it wasn&#8217;t done correctly the first time, means less judicial time available to hear substantive issues.</p>

<p>&#8220;One of our Operation Stand-By volunteers &#8211; Howard Gum of<br />
Asheville, NC &#8211; recently completed a difficult child custody jurisdiction<br />
matter for a Marine. He is on the Operation Stand-By list &amp; wrote to tell<br />
us of the experience. Here are his own words* &#8211;</p>
<p>In early July of 2005, I was contacted by phone by a Lieutenant Colonel, a<br />
Legal Assistance Attorney with the United States Marine Corps, on behalf of<br />
a Staff Sergeant in his command. The Legal Assistance Officer and the<br />
StaffSergeant were in the State of Virginia.</p>
<p>
The Staff Sergeant and his wife had three young children, ages 4, 3, and 2.<br />
The Staff Sergeant&#8217;s wife had fled the State of Virginia with all three<br />
children and showed up in Buncombe County, North Carolina.</p>
<p>She contacted a legal services office and presented them with allegations<br />
ofdomestic violence that caused her and the children to flee the State of<br />
Virginia. These allegations were subsequently proved to be groundless but<br />
they were sufficient for legal services to accept her case and file custody<br />
proceedings in North Carolina under the UCCJEA.</p>
<p>The Marine Corps Legal Assistance Attorney put the Staff Sergeant in touch<br />
with me and he related that his wife had had a history of emotional<br />
problemsand mental health issues and that he was very concerned for the safety and<br />
welfare of their children and did not know of their physical whereabouts<br />
although he was in intermittent and irregular contact by cell phone.</p>
<p>We agreed that he needed to retain counsel in Virginia to file an action<br />
there seeking custody of the children but it was clear that he could not<br />
afford to retain counsel in two states. He and his wife had recently<br />
purchased a new home (at her insistence) and one of the manifestations of<br />
her emotional and mental health problems was mismanagement of credit.</p>
<p>Under these circumstances, I agreed to represent the Marine on a pro bono<br />
basis and filed a Motion to Dismiss the North Carolina action under the<br />
provisions of the UCCJEA relating to jurisdiction. The Marine was able to<br />
retain a lawyer in Virginia to file an action on his behalf.</p>
<p>The matter came on for hearing in Buncombe County and after hearing the<br />
Court invoked the emergency custody provisions of the UCCJEA and awarded<br />
emergency custody of the three children to the Marine Staff Sergeant,<br />
pending action by the Virginia Court. Our Court declined to exercise any<br />
further jurisdiction in North Carolina and transferred the matter back to<br />
Virginia.</p>
<p>I understand the custody matter was resolved satisfactorily and favorably<br />
for the Marine Staff Sergeant in the Virginia proceeding. I was pleased<br />
and gratified to have the opportunity to assist this service member in a<br />
difficult and some times terrifying situation given that he did not know<br />
the circumstances of his very young children.</p>
